In mid August, 2011, DEC sent to HRVR a report critical of their DEIS findings, and suggested that the project plan be scaled back to the "conservation resort alternative". This version, as mentioned in the DEIS, would include a spa/hotel and facilities but would greatly reduce the number of residential units placed on sensitive terrain. Aside from this suggestion, DEC detailed 55 areas in which HRVR's DEIS was found lacking, from water supply and sewerage treatment to construction impacts. Hudson River Valley Resorts submitted their draft Final Environmental Impact Statement to the DEC on Wednesday, March 21, 2012. Details are not yet available, but the developer says that substantive changes have been made to the plan. Save The Lakes will closely scrutinize the FEIS when it is made available, in order to determine whether or not the document thoroughly addresses and mitigates points of concern. We urge the community to focus close attention on the details of the FEIS - the importance of this cannot be overstated. In essence, it will become the underlying "contract" between the developer and the state, the town, the county and the community. THE BACK STORY On May 4, 2011, DEC accepted HRVR's Draft Environmental Impact Statement for public review. The period for the submission of written comments by the public closed on July 12, 2011 - written comments by the Town of Rosendale were accepted by DEC until July 21, 2011. What comes next, now that Save the Lakes, the Sierra Club and numerous individuals have responded to Hudson River Valley Resort's DEIS? How does the process work? There are two phases going on simultaneously: 1) HRVR's preparation of a Final EIS, and 2) HRVR's application for the many permits they require to press forward. 1) The Final EIS In short, DEC submitted the written comments to HRVR, and HRVR must take them into consideration as they draft their Final Environmental Impact Statement. The timeline is to be determined. DEC also submitted to HRVR their DEIS comments and the suggestion that the plan be scaled back. (see pdf link above) Rebecca Crist of DEC Region 3 explains the process this way: "Once all the comments have been compiled and provided to the applicant, DEC (as Lead Agency) will have the applicant respond to all substantive comments by drafting a preliminary final EIS. The Department will then review this preliminary document to ensure that the analyses and conclusions accurately represent the Department's assessment prior to accepting a final EIS. The SEQR regulations state that 'the lead agency must prepare or cause to be prepared and must file a final EIS, within 45 calendar days after the close of any hearing or within 60 calendar days after the filing of the draft EIS, whichever occurs later'. The later date would be 45 calendar days after the close of the hearing, which is July 21, 2011. However, it is impractical for DEC or the Applicant to respond to all comments within this deadline. Therefore, consistent with NYCRR Part 617, the Department will be extending the timeline for the preparation of the final EIS, and expects to meet with HRVR soon to establish a time frame for preparation of a final EIS." 2) Permits HRVR must get approval for a wide variety of permits it will need for the project. The applicant has submitted permit applications to DEC. When DEC accepts them for review there will be a hearing and 30 day public comment period during which time STL and other interested parties will respond. Save the Lakes will continue to weigh in with our comments about the adequacy of HRVR's responses and DEC's expectations and requirements of the developer. We will continue to press for transparency as the SEQR process unfolds. |
